New York State Department of Health inspects retail food service, restaurants, temporary, and mobile food facilities in localities with no food inspection program. They cover Delaware, Essex, Franklin, Fulton, Greene, Hamilton, Herkiner, Jefferson, Lewis, Montgomery, Ontario, Ostego, Saratoga, Schuyler, St. Lawrence, Steuben, Sullivan, Warren, Washington, and Wayner counties. The rest of the counties are local jurisdiction with retail food protection programs that permit and inspect food service operations within the state. New York is a home rule state, so local agencies that are enforcing retail food laws must adopt state regulations, but may promulgate regulations that are more stringent.
